Module Learning Strategies
Content will be delivered off-site by SERCO with the assistance of Staffordshire University employees. The following learning strategies are therefore presented.

- 8 x 3 hour workshops


Specify the number of independent study hours attributed to each type of activity (eg reading / assessment preparation). Total hours should equate to Independent Study Hours identified on page 1 of this form.

- Preparation for Workshops - reading - 20 hours
- Reflection on workshops, with associated reading - 40 hours
- Assessment preparation - 26 hours
- Practical application in the workplace - 40 hours
Module Indicative Content
This module uses pre-read materials and workshop delivery techniques, including presentations, discussion and reflection, in conjunction with practical exercises. Both the theory and Practical exercises will enable students to increase their knowledge and skills when working in Civil Enforcement.

a) The module includes content on the following subjects:
b) Introduction- overview of magistrates' court distraint;
c) Regulatory framework-
- Bailiff certification;
- Magistrates' court approval of bailiffs;
- ECHR;
- Equality Act 2010;
- Insolvency & fines collection;
- National Standard for Enforcement Agents- vulnerability, complaints & good practice.
d) Initial matters- issue of warrants, postponement etc;
e) Rights of entry- time & place of entry; use of force;
f) Levy procedure-
- Seizure & impounding;
- Goods- distrainable assets, exemptions & third party claims to ownership;
- Inventories & notices.
g) Sale & payment-
- Removal for sale;
- Public auction;
- Proceeds & accounts;
- Handling payments.
h) Risk assessment
i) National Standard for Enforcement Agents;
j) Fee scales for HMCTS work
k) County court risk assessment codes.
l) Conflict management
Module Special Admissions Requirements
This course is to be undertaken by existing employees or potential employees of SERCO only.
All Students will be selected by SERCO
Module Additional Assessment Details
This module will include two pieces summative assessment:

1) A Multiple short answer question Paper, weighted at 50%
2) A Practical assessment of applied skills, weighted at 50%
3) Formative assessments will be included throughout the course.

Students must obtain 40% or above in both elements of assessment in order to pass the module.
