Module Indicative Content
You should be able, throughout the process, to:
- identify the client's goals;
- investigate and identify the relevant facts;
- research and identify the relevant legal issues;
- identify alternative means of achieving the client's goals;
- advise the client on the legal consequences of his or her proposals;
- identify the overall nature of the process necessary to further the client's goals;
- plan the progress of the process to promote your client's interests;
- carry out the process through a series of steps and decisions;
- in appropriate circumstances, draft documentation to effect the process in clear and unambiguous language and with correct grammar;
- recognise conflicts of interest and act within the rules of professional conduct;
- recognise and advise the client of the various costs implications involved in the process.
You should be able to perform these tasks in the contexts of negotiated settlements or court proceedings and be able to distinguish the problems arising in the marital/civil and non-marital partnership.
Module Additional Assessment Details
One 2.5 hours open book examination covering all learning outcomes.
Module Learning Strategies
Under our scheme, the elective subjects are delivered in a 10 week period at the end of the course, comprising 9 weeks of class contact and one week of self-directed study over the Easter vacation. There are approximately 4 hours per week of class contact for each subject made up of one whole group session and one workshop, each of two-hours' duration.
