Module Indicative Content
This module will explore the legislation surrounding social care and in particular learning disability services, including Mental Capacity Act 2005, Mental Health Acts, Equality Act 2010, Human Rights Act 1998 and The National Health Service and Community Care Act 1990. Health and Safety Legislation will be examined in light of challenging behaviours and risk management when promoting independence. Students will gain an understanding of how legislation impacts on the care given and received
Current policy will be explored through Safeguarding procedures, Commissioning in Staffordshire and through implementation of Valuing People, (DoH, 2001) and Valuing people Now (DoH, 2009).
Module Additional Assessment Details
An essay of 2000 words maximum (contributes to meeting all LO's) 100%
The essay will draw on your experiences in working in learning disability services to evidence that you understand how to work in a lawful, ethical and accountable way. You will discuss how the legal framework applies to your role and your responsibilities to uphold legislation whilst ensuring that those individuals receiving your support are safeguarded whilst you promote independence and maximise the full potential of each individual.
Formative Assessment:
Develop an assignment plan and share with module tutor, feedback will be given on the plan.

This module is delivered as part of the University Certificate in Promoting Excellence in practice in Learning Disability Services or can be offered as a single continuous professional development module.

Module Learning Strategies
Contact Hours: (24)
Whole Group Sessions (12 hour) Lectures will be used to provide exposition of the key laws and policy framework pertaining to Learning Disability services.
Students will engage in discussion and exercises to explore the impact legislation has on care planning and delivery of care activities.
Small group Sessions (12 hour) Legal framework 4 hours, Safeguarding procedures and risk assessment 4 hours and framework relating to Mental Capacity 4 hours.
These will be utilised to encourage deep learning through an exploration of activities and case studies to ensure understanding and application of legal and policy framework to practice. The tensions and potential conflicts between different laws will be explored through case studies which will be discussed and debated.
Independent Study (126 hours)
36 Hours to prepare for lectures by reading recommended resources
12 Hours to reflect on sessions and plan wider reading
44 Hours to consolidate learning following face to face sessions. This will include using books, journal articles, newspaper articles, discussion with line managers and work colleagues and other participants undertaking this module. There will also be activities on the BlackBoard VLE for students to undertake. In addition, there will be an expectation for students to engage with organisational policies and procedures in place in their work place.
